Hosting Homes & Hosting Holidays - Terms & Conditions

1. Definitions

1.1. Hosting Homes Ltd is a company registered in England and Wales, registration number 116 217 07, with its registered office at 62A Bell Street, Henley-On-Thames, RG9 2BN. Hosting Holidays is a trading name of Hosting Homes Ltd.

1.2. "You" or "Your" refers to the person or organisation making the booking through Hosting Homes.

1.3. "Owner" refers to the legal owner or landlord of the property being rented through Hosting Homes.

1.4. "Property" refers to the accommodation provided for short or long-term stays, as specified in the booking confirmation.

2. The Booking

2.1. A booking becomes legally binding upon written confirmation from Hosting Homes, acting as the property owner’s agent, once the booking is accepted. These terms and conditions then become binding on all parties. The contract is between you and the property owner, with Hosting Homes acting solely as the agent.

2.2. This agreement does not constitute an assured shorthold tenancy or any other form of tenancy under UK law. It is a short-term letting agreement for the provision of accommodation for leisure, business, or temporary purposes only. As such, guests do not have exclusive possession of the property and do not hold tenancy rights under the Housing Act 1988 or any other housing legislation. This agreement is classified as an excluded agreement under section 3A(7)(a) of the Protection from Eviction Act 1977.

2.3. For bookings made outside of Airbnb, you must accept these terms and conditions, provide a valid form of government-issued ID (e.g., passport or driving licence), and pay the required damage deposit before the stay can proceed. Keys will not be released until these steps are completed.

2.4. For bookings made through Airbnb, you must accept these terms and conditions and upload a valid government-issued ID. A separate damage deposit is not required for Airbnb stays, but any damages or breaches of these terms will be subject to Airbnb’s resolution process.

2.5. Bookings may only be made by individuals aged 25 or above, with at least one guest aged 25 or older staying in the accommodation.

2.6. Bookings cannot be re-sold or re-assigned without written consent from Hosting Homes. Any bookings made on behalf of another person must be agreed upon in writing.

2.7. Hosting Homes reserves the right to terminate a booking and require guests to vacate the property at any point during their stay, whether due to a breach of these terms and conditions or for other reasonable grounds (such as unforeseen circumstances or safety concerns). Any partial refunds for unused dates or remaining nights will be at the sole discretion of Hosting Homes, depending on the circumstances of the termination.

3. Payment and Cancellations

3.1. Short Stays (up to 14 nights): 50% of the payment is due at the time of booking, with the remaining 50% due five days before check-in. Full payment must be received before access to the property is granted.

3.2. Long Stays (14-30 nights): Full payment must be made 14 days prior to the start of the booking. For stays extending beyond one month, subsequent payments must be made by the 15th of the preceding month. Failure to meet these deadlines may result in the release of the reserved dates and forfeiture of the booking.

3.3. Cancellations:

Cancellations made more than 10 days before the booking date will result in a full refund.

Cancellations within 10 days may forfeit the booking amount at the discretion of Hosting Homes.

3.4. Special Peak Periods (e.g., Royal Henley Regatta/Henley Festival/Rewind Festival): Bookings during peak periods are non-refundable. Any refund granted during these periods is at the sole discretion of Hosting Homes.

3.5. Termination for Breach: If a guest breaches any of these terms and conditions, Hosting Homes reserves the right to terminate the booking immediately. Guests must vacate the property upon request. No refunds will be provided during peak periods, and partial refunds for other periods are at the sole discretion of Hosting Homes.

3.6. If full payment is not received by the due date, Hosting Homes reserves the right to deny access to the property, and the booking will be treated as cancelled. In such cases, cancellation policies, including any forfeiture of deposits or payments, will apply.

4. Your Stay

4.1. The stay is valid only for the period between the check-in time and the check-out time on the dates specified in your booking confirmation. Any use of the property outside of these times may result in additional charges or termination of the booking. Check-in and check-out times will be confirmed in your reservation. Early check-ins or late check-outs will incur additional fees unless otherwise agreed in writing. Unauthorised check-ins or check-outs may incur fees ranging from £50 to £100.

4.2. The property includes basic consumables such as linens, towels, shower gel, and an initial supply of tea and coffee.

4.3. While Wi-Fi is provided where available, no guarantee of speed or uninterrupted service is offered.

4.4. You are responsible for the conduct of all individuals staying at the property. Any breach of these terms by you or your guests may result in eviction without refund.

4.5. Guests are responsible for the safe return of any keys, access cards, or fobs provided. Failure to return these items at the end of the stay may result in a replacement fee, which will be deducted from the damage deposit or charged directly to the guest.

5. Damage, Theft, and Cleaning Costs

5.1. Damage Deposit: A fixed damage deposit must be paid in full prior to check-in. The exact amount will be detailed in your pre-check-in link. Alternatively, you may be offered the option to pay a non-refundable damage waiver, which covers up to 50% of the deposit amount. For example, if the deposit is £500, the waiver would cover up to £250 for accidental damage. Any damages exceeding this amount, or damages not considered accidental, will still require full recovery of funds from you.

For Short Stays (up to 14 nights), if no damage or theft occurs and the check-out is completed in accordance with the terms, the damage deposit will be refunded in full. Refunds are typically processed within 7-14 days following a satisfactory property inspection.

For Long Stays (14-30 nights), a refundable damage deposit of 25% of the total rent is required, payable in full before check-in. If no damage or theft occurs, and check-out is completed in accordance with the terms, the damage deposit will also be refunded in full. Refunds are typically processed within 7-14 days following a satisfactory property inspection.

5.2. Damage or Theft Charges: Any damage or theft will be charged to the credit/debit card used for booking. If payment was made via bank transfer (e.g., for longer stays), an invoice will be issued for the amount due. Charges include repair or replacement costs for property damage or theft, and a standard charge of £250 for smoking within the property. Additional charges may apply for damage beyond normal wear and tear.

5.3. Additional Cleaning Fees: A standard cleaning service is included in the accommodation fee. If extra cleaning is required due to excessive dirt, stains, or neglected checkout tasks, the following fees will apply:

Standard deep cleaning: £50 per hour

Stained or Soiled Bedding, Linen, Throws, Cushions, or Towels: A charge of £50 per item will apply for any bedding, linen, throws, cushions, or towels that are stained or soiled beyond normal use. Additional charges may apply depending on the extent of the damage.

5.4. Charges for additional cleaning will be applied after checkout, with a breakdown of costs provided.

6. Mid-Stay Cleaning (For Long Stays Only)

6.1. For long stays, complimentary mid-stay cleaning, including linen changes, will be provided every two weeks. Guests must vacate the property during the cleaning.

7. Privacy and Data Protection

Please refer to our Privacy Policy https://www.hostingholidays.com/privacypolicy for full details on how we handle personal data. Hosting Homes follows strict data protection policies and ensures secure storage and handling of all personal information.

8. Complaints and Enquiries

8.1. If any issues or damages are noticed upon arrival, you must report them to the Hosting Homes team immediately. Failure to do so may result in you being held responsible for the damages, as they will be assumed to have occurred during your stay. Under no circumstances should you contact the property owner directly.

8.2. If the issue cannot be resolved during your stay, formal complaints must be submitted via email to guests@hostingholidays.com or via post to 62A Bell Street, Henley-On-Thames, RG9 2BN.

8.3. Complaints related to Hosting Homes’ services (e.g., booking process or communication) should also be submitted via email to guests@hostingholidays.com or via post to 62A Bell Street, Henley-On-Thames, RG9 2BN.

8.4. Formal complaints must be submitted no later than 24 hours after check-out. Any complaints raised after this period will not be considered unless deemed an exceptional circumstance by Hosting Homes.

8.5. Hosting Homes will aim to respond to formal complaints within 2 working days. Please note that complaints deemed vexatious or made in bad faith may be rejected without further investigation.

9. Limitation of Liability

9.1. Hosting Homes as Agent: Hosting Homes acts solely as an agent for the property owner and holds no liability for your stay. All liability for the accommodation rests with the property owner.

9.2. Property Owner’s Liability: The property owner's liability is limited to the total value of your booking. This limitation does not apply in cases of negligence or wilful misconduct, where the property owner’s liability may extend to direct, foreseeable losses caused by their actions.

9.3. Hosting Homes' Accuracy and Information: Hosting Homes endeavours to provide accurate and up-to-date information regarding the property and your stay. However, Hosting Homes will not be held liable for any inaccuracies or omissions in the information provided unless such inaccuracies were caused by negligence.

9.4. Indirect and Consequential Losses: Neither Hosting Homes nor the property owner shall be liable for any indirect or consequential losses, including but not limited to loss of profit, data, reputation, or goodwill, regardless of the cause.

9.5. Circumstances Beyond Control: Hosting Homes and the property owner shall not be held liable for circumstances beyond their control, including but not limited to:

Acts of God (e.g., natural disasters)

Strikes, labour disputes, or other industrial action

Acts of war, terrorism, or civil disturbances

Government actions or regulations

Failure or interruption of utilities or communication services

9.6. Health and Safety: Guests are responsible for their own health and safety during their stay. Hosting Homes and the property owner are not liable for any injuries, illness, or accidents that occur on the property unless they arise from negligence.

9.7. No Waiver of Rights: Nothing in this clause shall limit or exclude liability for death or personal injury caused by negligence, fraudulent misrepresentation, or other matters for which liability cannot be legally excluded.

9.8. Hosting Homes recommends that guests purchase travel insurance to cover potential cancellations, accidents, or property loss during their stay. Hosting Homes and the property owner are not responsible for any costs or losses arising from circumstances not covered under this agreement.

10. Severability

10.1. If any provision of these terms and conditions is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced with a valid provision that comes closest to the intent of the original provision.

11. Waiver

11.1. The failure or delay of any party to enforce any provision of these terms and conditions at any time shall not be deemed a waiver of that party’s right to enforce the same provision or any other provision in the future.

11.2. A waiver of any breach of these terms will not be deemed to be a waiver of any subsequent breach. Any waiver must be made in writing and signed by the party granting the waiver to be considered valid and enforceable.

12. Entire Agreement

12.1. These terms and conditions constitute the entire agreement between the parties regarding the subject matter herein and supersede all prior or contemporaneous communications, agreements, negotiations, or understandings, whether oral or written.

12.2. No other agreements, representations, warranties, or promises shall be binding on the parties unless expressly included in these terms or agreed upon in writing by both parties.

13. Third-Party Rights

13.1. The property owner shall be entitled to enforce its rights under this Agreement against you or any person staying at or using the accommodation.

13.2. Otherwise, nothing in this Agreement is intended to, nor shall, confer any rights on a third party unless expressly provided otherwise.

14. Jurisdiction

14.1. This Agreement shall be construed in accordance with English Law, and the Courts of England and Wales shall have exclusive jurisdiction over any matters arising from this Agreement.

15. The Guest’s Obligations The Guest agrees:

That in no circumstances should overnight accommodation be provided for guests other than those declared to Hosting Homes and notified in advance.

To pay for any losses or damage to the property caused.

To take good care of the property and leave it in a clean and tidy condition at the end of the stay.

To permit the property owner and Hosting Homes reasonable access to the property.

Not to cause an annoyance or become a nuisance to occupants of adjoining premises.

Noise levels must be kept to a minimum, especially between the hours of 10 p.m. and 9 a.m. If Hosting Homes receives complaints from neighbours or local authorities due to excessive noise, this may result in the immediate termination of the stay without a refund.

Not to smoke in the property or any public areas associated with it.

Not to bring any pets to the property without permission.

To read any safety notices and advice upon arrival.

Not to re-let or sublet the property to any other group/party.

To only use the property strictly for residential purposes.

Not to use the property for parties or gatherings. If it is suspected that the Guest intends to use the property for such an event, they will be refused entry with no refund.

Not to light any fires or candles in the property.

Not to permit any visitors to enter the property.

Not to hang or place wet or damp articles of washing upon any room heater.

Deep frying or the use of any deep fryer is strictly prohibited at all of our properties.
